Terms for the Schubl AI website and photo-editing service.

1. About these terms

Schubl AI is operated by Schubl Pty Ltd, ABN 17 697 826 690, in Queensland, Australia. These Terms & Conditions are also our Terms of Service and cover our marketing website and AI photo-editing service.

If you use the service for a business, you must have authority to act for that business. You are responsible for accurate account information, protecting access to your account and the activity you authorise.

2. AI editing and your responsibilities

For editing services intended to preserve the original scene, Schubl AI is designed to produce edits that remain faithful to the source photographs and preserve the property's appearance. However, automated processing can introduce errors, omit details or unintentionally alter features. Review every result before delivery or publication.

Advertising laws, property-listing standards and AI-editing disclosure requirements vary between jurisdictions and platforms. We cannot guarantee that an edited image meets every applicable requirement. You are responsible for checking the requirements that apply to your intended use and making any necessary disclosures.

Testing and beta features may change and may experience interruptions. Nothing in this section excludes any guarantees, rights or remedies that apply by law.

3. Your images and permissions

You retain your rights in the photographs and other material you upload. We do not claim ownership of your source photographs. As between you and us, you may use the delivered results for your business, subject to any underlying third-party rights. We do not guarantee that an AI-generated element qualifies for copyright protection.

Only upload material you are entitled to provide. Obtain any permissions needed from copyright owners, clients and identifiable people for the uses you allow. Ownership of a photograph alone does not necessarily authorise every use of the personal information shown in it.

You grant us a non-exclusive licence to host, copy, process, modify and deliver your material as needed to provide the service, including limited access by authorised staff and service providers for support, troubleshooting and quality checks.

4. Training and marketing permissions

The service has separate AI-training and marketing-use settings, both enabled by default. These permissions are subject to applicable law and any notice or additional consent required.

When AI-training use is enabled, the licence allows us to use uploaded photographs and results to train, evaluate and improve Schubl AI models. The business setting is recorded when each order is created. Turning training use off applies to orders created after the change is saved, not existing drafts or orders. All photographs, edited results, reruns and add-ons in an order use that order's recorded setting, including files added later. Orders recorded with training use enabled remain eligible for future training, evaluation and model improvement, even if their images have not yet been used. Opting out does not require removal of previously permitted images from datasets or reversal of completed training, subject to applicable law.

When marketing use is enabled, the licence allows us to reproduce, resize, crop and publicly display uploaded photographs and results to demonstrate or promote Schubl AI, including before-and-after examples on our website, social channels and marketing materials.

The business setting is recorded when each order is created. Turning marketing use off applies to orders created after the change is saved, not existing drafts or orders. All photographs and derived results in an order use that order's recorded setting, including files added later. Orders recorded with marketing use enabled remain eligible for future marketing, even if their images have not yet been published. Existing marketing materials may remain in use; opting out does not itself require their removal or recall, subject to applicable law.

Neither opt-out prevents processing your orders or authorised internal support and quality review. The two settings are independent. Only the business owner may change these settings. Enabling a setting again affects newly created orders; it does not change permissions already recorded for an order. Orders without a recorded permission are not treated as permitted for that use. These settings do not limit any rights you or another person may have under applicable law. The Privacy Policy explains requests concerning previously uploaded images.

5. Pricing and payments

The applicable price, currency and taxes should be shown before you confirm a paid purchase. Planned beta or release pricing is not a charge for current free testing. Check the price presented at purchase rather than relying on an earlier marketing example.

The service uses Wallet Credit and Stripe payment processing. Any optional automatic top-up requires your authorisation. Saving a card alone is not permission for arbitrary charges. See Payments & Credit Card Security and the Refund Policy for further details.

6. File availability

Schubl AI is not a permanent archive or backup service. Download your originals and completed results and keep independent backups. No fixed storage duration is promised. See the Privacy Policy for retention and deletion information.

Training and marketing opt-outs restrict those uses. They do not automatically delete the order files needed to provide your service. Contact us separately about deletion or account closure.

7. Acceptable use and access

Do not upload unlawful material, infringe others' rights, access another customer's content without permission, interfere with the service or misuse payment facilities.

We may restrict access where reasonably necessary to address misuse, security risks or legal obligations. Where appropriate, we will explain the reason and provide a way to contact us. Restricting access does not remove your statutory rights or automatically forfeit any entitlement to a refund.

8. Consumer rights and responsibility

Nothing in these terms excludes, restricts or modifies a guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law. Business purchases may also qualify for consumer protections.

AI output limitations and your obligation to review results do not excuse us from obligations imposed by law. If something goes wrong, contact us so we can assess the issue and the remedy that applies. We do not require you to accept Wallet Credit instead of a monetary refund where the law entitles you to one.

9. Changes, disputes and contact

Material changes will be notified before taking effect where required, with additional agreement or consent obtained where necessary. A later policy change does not by itself grant new rights over previously uploaded content.

The governing law is Queensland, Australia, subject to any mandatory protections or rights to bring a claim elsewhere that apply to you. Contact hello@schubl.com about these terms or a dispute.
